3M to Pay $6 Billion Settlement Over Defective Earplugs Causing Hearing Loss – 3M earplugs lawsuit

3M, a multinational conglomerate, has reached a settlement to pay over $6 billion in a class-action lawsuit brought by consumers and military members who claimed that the company’s earplugs were faulty and led to hearing loss, tinnitus, and other hearing-related injuries. The settlement terms stipulate that 3M will disburse the funds between 2023 and 2029, with $5 billion in cash and $1 billion in 3M common stock. However, 3M maintains that the agreement does not imply an admission of liability and asserts that their earplugs are safe and effective when used properly.

The lawsuit pertained to the Dual-Ended Combat Arms Earplugs, CAEv.2, manufactured by Aearo LLC from 2003 to 2015, which became loose and exposed users to hazardous levels of noise. Aearo LLC was acquired by 3M in 2007. Users of the earplugs ranged from civilians using them for hunting or industrial work to military personnel for various tasks involving firearm training, vehicle maintenance, and noise-exposed conditions.

Numerous individuals suffered hearing impairments, tinnitus, and other hearing-related issues. The lawsuit alleged that the defendants manipulated the Noise Reduction Rating (NRR) labeling tests, a standard required by the American National Standards Institute. The complaint contended that the defendants used their own lab and improper testing methods to skew NRR results, presenting a misleading effectiveness rating.

This is not the first time 3M faced legal issues related to these earplugs. In 2018, the Department of Justice revealed that 3M had agreed to pay $9.1 million to settle allegations that the same earplugs were sold to the U.S. military without disclosing the defects. The settlement comes after Aearo’s attempt to file for Chapter 11 bankruptcy, which was dismissed by a judge who deemed the company financially sound.
